OVERVIEW

Welcome to Stone Theory Studio. Throughout these Terms, “we”, “us” and “our” refer to Stone Theory Studio.

These Terms of Service (“Terms”) govern your use of our website, products and services (the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy 

If you do not agree, you must not use our Services.

Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law (ACL).

1. ACCESS AND USE

You must be at least 18 years old, or have permission from a parent or guardian, to use our Services.

You agree that all information you provide is accurate and complete. You are responsible for maintaining the security of your account and for all activity under it.

2. PRODUCTS

We make every effort to display our products accurately. However:

  • Colours and appearance may vary depending on your device

  • As many items are handmade, slight variations may occur

These variations do not constitute a fault under Australian Consumer Law.

We reserve the right to modify or discontinue products at any time.

3. ORDERS

When you place an order, you are making an offer to purchase.

We reserve the right to accept or reject any order. An order is only confirmed once payment has been received and processed.

Once an order is confirmed, cancellations may not be possible.

All purchases are subject to our Refund Policy 

4. PRICING & PAYMENT

All prices are listed in Australian Dollars (AUD) unless stated otherwise.

Prices may change at any time without notice.

You agree to provide accurate payment details and authorise us to charge the full amount, including any applicable shipping costs.

5. SHIPPING & DELIVERY

Delivery timeframes are estimates only and not guaranteed.

We are not responsible for delays caused by carriers or events outside our control.

Risk of loss or damage passes to you once the item has been dispatched.

6. AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:

  • A replacement or refund for a major failure on goods made or supplied by us.

  • Repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure

Nothing in these Terms limits your rights under the ACL.

7. CUSTOM WORK & REPAIRS

Custom-made items and jewellery repairs:

  • Are not refundable for change of mind once work has commenced or been completed

  • May only be eligible for remedy if faulty under ACL and the fault is our own and not in the quality of manufacturing of the item not made or supplied by us.

  • Will be repaired where possible before any refund is considered

8. INTELLECTUAL PROPERTY

All content on this website, including images, branding, and designs, is owned by Stone Theory Studio.

You may not use, copy, or reproduce any content without written permission.

9. THIRD-PARTY SERVICES

Our website is hosted by Shopify and may include third-party tools or links.

We are not responsible for third-party services, websites, or content.

10. PRIVACY

Your personal information is handled in accordance with our Privacy Policy 

11. FEEDBACK

If you provide feedback, you grant us the right to use it without restriction or compensation.

12. ERRORS

We reserve the right to correct errors, inaccuracies, or omissions, including after an order has been placed.

13. PROHIBITED USE

You must not use our Services for any unlawful or harmful purpose, including:

  • Fraud or misleading conduct

  • Interfering with website functionality

  • Breaching intellectual property rights

We may suspend or terminate access if these Terms are breached.

14. LIMITATION OF LIABILITY

To the extent permitted by law, we are not liable for indirect or consequential loss.

However, this does not apply to rights or remedies you are entitled to under the Australian Consumer Law.

These Terms are governed by the laws of Victoria, Australia.

Any disputes will be handled in the courts of Victoria.

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of any changes.
